Terms of Service

1. Acceptance of Terms
These Terms of Service govern access to and use of loomrealty.com, Loom Realty account features, Broker of Record onboarding materials, lead forms, email lists, and related communications. By using the website, creating an account, submitting information, or requesting BOR services, you agree to these Terms.
2. Parties Protected
These Terms protect Loom Realty, Kayla Jane Bramante, David Levine Bramante, their affiliates, contractors, service providers, successors, and authorized representatives. References to "Loom Realty," "we," "us," or "our" include those protected parties where applicable.
3. BOR Services
Loom Realty provides California real estate Broker of Record supervision, onboarding coordination, compliance support, document review workflows, and related business communications for eligible clients. Services are subject to written agreements, broker approval, DRE requirements, payment status, insurance requirements, and ongoing client cooperation.
Website content does not create a broker-client relationship, agency relationship, fiduciary duty, or obligation to supervise your activities unless and until a written BOR agreement is fully executed and accepted by Loom Realty.
4. No Legal, Tax, Insurance, or Financial Advice
Loom Realty is not a law firm, CPA firm, insurance broker, financial advisor, or employment advisor. Website content, checklists, emails, account prompts, and BOR communications are informational and operational in nature. You are responsible for obtaining advice from qualified legal, tax, insurance, accounting, licensing, employment, and financial professionals.
5. Client Responsibilities
You agree to provide accurate, current, and complete information, including:
- Entity, ownership, officer, agent, license, and contact information
- Unit count, service locations, property management activity, and leasing activity
- BOR agreement status, insurance policies, additional insured endorsements, and renewal dates
- Claims, disputes, complaints, DRE notices, insurance lapses, trust fund issues, advertising issues, and operational changes
- Billing and payment information required to maintain active service
Failure to disclose material information may result in service delay, suspension, termination, or required corrective action.
6. Account Access
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You may not share access, impersonate another person, upload unlawful content, interfere with platform operations, or attempt to access data that does not belong to you.
7. Payments and Service Status
BOR fees, onboarding fees, filing fees, third-party fees, and payment schedules are governed by the applicable written agreement or payment page. Nonpayment, disputed charges, expired payment methods, missing documentation, or loss of required insurance may affect service status.
8. Marketing Communications
By submitting a lead form, joining the BOR email list, or creating an account with marketing consent, you authorize Loom Realty to contact you about BOR services, onboarding, compliance reminders, account status, and related services. You may opt out of non-transactional marketing emails, but operational, billing, legal, security, and BOR service communications may still be sent.
9. Intellectual Property
Site content, checklists, workflows, copy, graphics, logos, forms, templates, page structure, and related materials are owned by or licensed to Loom Realty and may not be copied, sold, scraped, republished, or used to build competing services without written permission.
10. Third-Party Services
Loom Realty may use third-party services including payment processors, authentication providers, database providers, email providers, communication platforms, document tools, and analytics tools. Their services are governed by their own terms and privacy practices.
11. Disclaimers and Limitation of Liability
The site and account tools are provided on an "as available" basis. To the fullest extent permitted by law, Loom Realty and the protected parties disclaim warranties and are not liable for indirect, incidental, consequential, special, punitive, lost-profit, data-loss, business interruption, or reliance damages arising from website use, account use, third-party services, or informational content.
12. Governing Law
These Terms are governed by California law, without regard to conflict of law rules. Venue for disputes shall be in the state or federal courts serving Los Angeles County, California, unless a written agreement states otherwise.
13. Changes
We may update these Terms by posting a revised version on the website. Continued use after posting means you accept the updated Terms.
